If the Website allows you to create an account, join a community area, submit materials, or otherwise interact with other users:

  • you must provide accurate and up-to-date information;
  • you are responsible for maintaining the confidentiality of your login credentials;
  • you are responsible for activities carried out through your account, unless caused by our fault;
  • you must notify us without undue delay if you suspect unauthorised access to your account.

We may suspend or remove accounts, posts, comments, submissions, or other materials that, in our reasonable opinion, violate these Terms, applicable law, or the rights of others.

4. User Content

If you post, upload, share, submit, or otherwise make content available through the Website (“User Content”), you represent and warrant that:

  • you own the relevant rights or have all necessary permissions to provide such User Content;
  • the User Content is lawful, accurate to the best of your knowledge, and does not infringe any third-party rights;

To the extent necessary for operating the Website and related community features, you grant FBC a non-exclusive, worldwide, royalty-free, revocable licence to host, store, reproduce, display, and make available your User Content solely for the purpose of operating, administering, improving, and promoting the relevant Website services.

We do not generally pre-monitor all User Content and are not obliged to do so, but we may remove or restrict access to User Content where required by law or where we reasonably believe it breaches these Terms.

Nothing in these Terms grants you any intellectual property rights except the limited right to use the Website in accordance with these Terms.

6. Third-Party Links and Resources

The Website may contain links to third-party websites, platforms, tools, or resources. These are provided for convenience only.

Unless expressly stated otherwise, FBC does not control, endorse, or assume responsibility for any third-party content, services, products, policies, or practices. Your use of third-party websites is at your own risk and subject to the terms and policies of those third parties.

7. Availability, Security, and Website Changes

We aim to keep the Website available and reasonably secure, but we do not guarantee that the Website will always be available, uninterrupted, timely, error-free, or free from vulnerabilities or harmful components.

We may, at any time and without liability, to the extent permitted by law:

  • update, modify, suspend, withdraw, or discontinue all or any part of the Website;
  • restrict access to some or all parts of the Website;
  • implement technical, security, or operational changes.

You are responsible for ensuring that your device, software, and internet connection are suitable and secure for accessing the Website.

8. Disclaimer

The Website and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, FBC makes no representations or warranties, express or implied, regarding:

  • the accuracy, completeness, reliability, suitability, or availability of the Website or its content;
  • fitness for a particular purpose;
  • non-infringement;
  • uninterrupted or error-free operation.

Nothing on the Website constitutes a binding offer unless expressly stated otherwise.

9. Limitation of Liability

To the fullest extent permitted by applicable law, FBC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, business, opportunity, goodwill, anticipated savings, or data, arising out of or in connection with the use of, or inability to use, the Website.

FBC shall be liable only for direct damages proven to have been caused by FBC’s breach of these Terms or applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including, where applicable, liability for:

  • fraud or fraudulent misrepresentation;
  • wilful misconduct or gross negligence;
  • death or personal injury caused by negligence;
  • infringement of mandatory consumer rights;
  • any other liability that cannot be lawfully excluded or limited.

10. Privacy and Cookies

We process personal data in accordance with applicable data protection laws, including Regulation (EU) 2016/679 (GDPR) and relevant Lithuanian legal requirements.

Further information on how we collect, use, store, and protect personal data is available in our Privacy Policy.

Where the Website uses cookies or similar technologies, additional information will be provided in our Cookie Policy and, where required by law, through appropriate consent mechanisms.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in the law, regulatory requirements, our services, or the Website’s functionality.

The latest version of the Terms will be published on the Website with the updated “Last updated” date.

Any changes will take effect upon publication, unless a later effective date is stated. Where changes materially affect users’ rights or obligations and applicable law requires it, we will take reasonable steps to bring such changes to users’ attention.

Continued use of the Website after the effective date of updated Terms constitutes acceptance of the revised Terms, except to the extent that mandatory law requires a different method of acceptance.

12. Force Majeure

FBC shall not be liable for any delay or failure in performance to the extent caused by events beyond its reasonable control, including failures of telecommunications networks, internet outages, cyberattacks, labour disputes, acts of government, natural disasters, epidemics, pandemics, or other force majeure events.

This clause does not affect rights that cannot be excluded under mandatory law.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania.

If you are a consumer residing in the European Union, this choice of Lithuanian law shall not deprive you of the protection afforded to you by mandatory provisions of the law of your country of habitual residence.

If you are not a consumer, any dispute arising out of or in connection with these Terms or the Website shall be subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania.

If you are a consumer, you may bring proceedings in the courts that have jurisdiction under applicable mandatory law, including, where applicable, the courts of your country of habitual residence.

14. Severability and No Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Any failure or delay by FBC to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights.
